Privacy Policy

This Privacy Policy sets out how THAI SEMCON CO., LTD. (hereinafter, the “Company”) handles and process the Personal Data of our customers, supplier, employees, workers and other third party in order to comply with Personal Data Protection Act B.E. 2562. This Personal Policy shall apply to all Personal Data with respect to the collection, use or disclosure regarding the rights of data subjects’ protection.

As the Company is based in Thailand, The Company declares that, concerning the personal data processed in its operations, we observe the laws, regulations, and other rules regarding the protection of personal data. We also establish rules and systems of our own, and provide, implement, and maintain our privacy policy as mentioned below.

1. What is Personal Data

“Personal Data” means any information relating to a Person, which enables the identification of such Person, whether directly or indirectly, but not including the information of the deceased Personal in particular. Examples of Personal Data that we may collect include name and contact details (e.g., postal address, e-mail address, telephone number etc.)

2. How we collect and receive Personal Data?

You will either be asked to explicitly consent to our collection, use and/or disclosure of your Personal Data or otherwise informed of the lawful basis on which such collection, use and/or disclosure is based.

3. Principles of processing Personal Data

    • The Company shall process Personal Data in accordance with the following principles.
    • 3.1 Process personal data lawfully, fairly and in a transparent manner in relation to a data subject.
    • 3.2 Process personal data only to the extent necessary for achieving the purposes specified in advance.
    • 3.3 Store personal data for the period necessary for achieving the purposes.
    • 3.4 Maintain personal data accurately and keep up to date to the extent necessary for the purposes.
    • 3.5 Process personal data by implementing appropriate technical and organisational measures.

4. The purposes of Personal Data processing

The purposes of processing the personal data processed by the Company are as follows:

  • For personal data of customers or business partners
  • (1) Promotion of our products and services including provision of related information (such as catalogue delivery)
  • (2) Sales/supply of our products and services, and customer support
  • (3) Product development
  • (4) Fulfilment of contracts
  • (5) Business negotiations, meetings, and other forms of communication
  • (6) Provision of information on seminars, exhibitions, and other events
  • (7) Response to inquiries and requests
  • (8) Surveys and analyses
  • (9) Providing personal data to Thai Semcon Co., Ltd. for achieving one or more of the purposes (1) through (8) above.
  • For personal data of employment applicants
  • (1) Provision of employment information to applicants and communication with them about selection procedures, etc.
  • (2) Providing personal data to the Thai Semcon Co., Ltd. for achieving the purpose (1) above
  • For personal data of employees of the Company (including but not limited to employees directly employed by the Company, officers, corporate advisors, staff seconded from staffing agencies, employees of other companies working at the premises of the Company)
  • (1) Engaging in work management, employee welfare, health and safety
  • (2) Providing education and training
  • (3) Communication and notifications
  • (4) Providing personal data to the Thai Semcon Co., Ltd.or subcontractors engaged by the Company for achieving one or more of the purposes (1) through (3) above
  • Others
  • (1) In the case of other purposes that are individually notified or published beforehand.

5. Legal basis of processing Personal Data

  • The Company shall process personal data based on one of the following legal bases:
  • 5.1 The Company has obtained the consent of the data subject or has communicated required matters to the data subject in accordance with applicable laws and regulations.
  • 5.2 The processing is necessary to perform the obligations under the contract with the data subject.
  • 5.3 The processing is necessary for the Company to fulfil its legal obligations.
  • 5.4 The processing is necessary to secure legitimate interests pursued by the Company.

6. Providing Personal Data to a third party

  • 6.1 The Company shall obtain consent from data subject for collection, use or disclosure personal data to a third party.
  • 6.2 If the Company transfers personal data outside Thailand, we will comply with our legal and regulatory obligations in relation to personal data, including having a lawful basis for transfer personal data and it shall implement safeguards required under applicable laws and regulations.

7. Taking actions on the rights of data subjects

The Company shall take appropriate actions on the data subject’s requests on the processing of personal data concerning him or her in accordance with applicable laws and regulations.

  • The Company shall respond to requests of the data subject specified below:
  • 7.1 Access to the personal data
  • 7.2 Rectification or erasure of the personal data
  • 7.3 Restriction on the processing of the personal data
  • 7.4 Lodging a complaint against the processing of the personal data
  • 7.5 Data portability of the personal data
  • 7.6 Withdrawal of consent on the processing of the personal data
  • 7.7 Contest against the processing of the personal data

8. Safeguards for the protection of Personal Data

The Company shall implement appropriate, necessary security measures for preventing the unauthorized or unlawful loss, access to, use, alteration, correction or disclosure of personal data. The Company shall also provide appropriate, necessary supervision over its employees, and subcontractors to ensure the protection of personal data.

9. Retention period

  • 9.1 The Company will retain personal data for period necessary to fulfil the purposes for which the personal data was collected in compliance with our obligations under Thai laws. After such period, the Company will destroy such personal data.
  • 9.2 The retention period will vary depending on the purposes for which the personal data was collected. Where any personal data is only useful for a short period. The Company may delete it at the end of such period.
  • 9.3 Data subjects have the right to request us to delete the personal data in some circumstance. Please note that the Company are sometimes legally obliged to retain your personal data, for example, for tax and accounting purposes.

10. Continuing initiatives to maintain and improve the system

Aiming to implement this policy, the Company shall establish necessary internal rules, provide education and training, and thoroughly communicate details of this declaration with its employees for strict adherence to ensure and maintain implementation of the policy.
